1. Giveaway & Period 

The “BERKAT BERSAMA: WOVEN THROUGH GENERATIONS” giveaway (“Giveaway”) is organised by Sunway Property. The giveaway period is from 6 March 2026 to 30 April 2026 (“Giveaway Period”). The deadline for submission is 11:59pm, 30 April 2026, Malaysia time. Late entries will not be accepted. Sunway Property reserves the right to extend, modify, suspend or terminate the Giveaway Period at any time for any reason, including but not limited to operational, administrative, regulatory or force majeure reasons, with or without prior notice, and Sunway Property shall not be liable to any participant or third party for any loss, cost or expense arising from such extension, modification, suspension or termination.

2. Eligibility

This Giveaway is open to all nationalities residing in Malaysia above the age of 18 as at the date of submission and who hold valid identification and lawful residency status in Malaysia. Individuals below the age of 18 may participate through a parent or legal guardian provided that such participation is accompanied by the express consent, representation and undertaking of the parent or legal guardian, who shall be deemed to be the participant for all legal purposes and shall be fully bound by and liable under these Terms & Conditions. By entering, participants warrant that all submissions are their original work, do not infringe on the rights of any third party, and shall indemnify and keep indemnified Sunway Property, its affiliates, officers, employees and agents against all claims, demands, losses, damages, costs and expenses (including legal fees on a solicitor-client basis) arising from or in connection with any breach of these Terms & Conditions, misrepresentation, illegality, or infringement of intellectual property, privacy or other rights in relation to the submissions. Sunway Property reserves the right to verify eligibility at any time (including requesting documentary evidence such as identification documents or proof of residency) and to disqualify any participant who does not meet the eligibility requirements or breaches these Terms & Conditions. 

3. Rules & Submission Format

No participation fee is required to enter this campaign. Participants may take part subject to compliance with the rules stated below. All costs and expenses incurred by participants in connection with the preparation and submission of entries shall be borne solely by the participants. Sunway Property reserves the absolute right to reject, disqualify or invalidate any incomplete, illegible, late, inaccurate or non-compliant entry without assigning any reason and its decision shall be final and binding, subject always to applicable law. 

• Online Raya Greeting Submission

Participants are required to submit an original written Raya greeting via the official Sunway Property campaign submission form on the Sunway Property website, in response to the campaign question as stated on the official campaign page. 

Each greeting must be the participant’s own original work and must not have been previously published, submitted, or used in any other contest, campaign, or publication, whether in Malaysia or abroad and must not contain any content that is unlawful, defamatory, obscene, offensive or otherwise inappropriate or that promotes discrimination, hatred, violence, or any unlawful activity.

• Online Raya Photo Submission

Participants are required to submit a Raya-themed image on the Sunway Property website. 

Each photo can be the participant’s own original work or AI-generated and must not have been previously published, submitted, or used in any other contest, campaign, or publication, whether in Malaysia or abroad and must not contain any content that is unlawful, defamatory, obscene, offensive or otherwise inappropriate or that infringes any third-party intellectual property, privacy or publicity rights. 

Where the photo contains the image or likeness of any identifiable individual, the participant represents and warrants that he/she has obtained the prior consent of such individual (or the parent/legal guardian, where applicable) for submission and use of the photo in accordance with these Terms & Conditions. 

4. Entry Process & Submission Limit

All entries must be submitted via the designated official submission platforms as stated on the Sunway Property campaign page, and Sunway Property shall not be responsible for any entries submitted through unauthorised platforms or affected by technical, system, network or transmission failures, including but not limited to lost, delayed, misdirected or corrupted data transmissions. 

Each participant is allowed a maximum of one (1) total entry throughout the Giveaway Period, comprising: – 

• One (1) online Raya wish submission via the Sunway Property website; and 
• One (1) Raya-themed image via the Sunway Property website 

In the event of duplicate or repeated photo submissions, whether identical or substantially similar, only the earliest valid submission (based on system timestamp) will be counted. All subsequent duplicate submissions will be disqualified. Any submission generated through automated bulk entry systems, bots, scripts, or similar mechanical or programmed methods intended to unfairly increase the chances of participation, as determined by Sunway Property in its sole discretion, shall be automatically disqualified. For the avoidance of doubt, the use of artificial intelligence tools for the creation of the submitted photo shall be permitted, provided that the submission complies with Clause 3.2 and all other applicable requirements under these Terms & Conditions. 

Sunway Property endeavours, but does not guarantee, to reflect qualifying submissions on the official Sunway Property campaign website within two (2) working days from the date of submission. Participants may check their submission status on the campaign website by searching for their names. 

5. Copyright and Usage Rights 

Entrants retain full copyright of their submitted images. By entering the Giveaway, entrants grant Sunway Property a royalty-free, non-exclusive perpetual, irrevocable, worldwide, transferable and sub-licensable license to use, reproduce, publish, display, adapt, modify, edit, distribute, communicate to the public and otherwise exploit the submitted images for promotional purposes related to the Giveaway, Sunway Property’s marketing campaigns, and future iterations of similar Giveaways in any media now known or hereafter developed. Sunway Property will give appropriate credit to the photographer where possible but shall not be liable for any failure to do so. Sunway Property reserves the right to edit, crop, or modify the submitted images as necessary for promotional purposes and the entrant hereby irrevocably waives any moral rights or similar rights to the extent permitted under Malaysian law. The participant further agrees that no royalty, fee or other compensation shall be payable by Sunway Property in connection with any use of the submitted images in accordance with these Terms & Conditions.

6. Photo Submission Requirements

Photo submissions must be submitted via the designated Sunway Property campaign page. Sunway Property reserves the right to request verification of the date, location and authenticity of the photo. 

Each photo must be Raya themed and includes the participant. Photo submissions that do not include the participant or do not clearly meet these requirements may be rejected at Sunway Property’s discretion and Sunway Property shall not be obliged to provide any reason for such rejection. 

All photo submissions must be: –

• Actual photograph OR AI-generated;
• Raya themed;
• Submitted in JPEG or PNG format; 
• Not exceeding 10MB in file size; and
• Free from any content that is misleading, offensive, defamatory, inappropriate, unlawful, infringing, discriminatory, sexually explicit, violent or otherwise objectionable. 

Participants are permitted to perform basic image enhancements such as cropping, brightness, or contrast adjustments. However, image manipulation, including but not limited to montage, superimposition, alteration of answers, or any editing that misrepresents the actual content of the photo, is strictly prohibited and any determination by Sunway Property in this regard shall be final and binding, subject always to applicable law. 

Where any third party appears in the submitted photo, the participant represents and warrants that prior consent has been obtained from such third party (or the parent/legal guardian, where applicable) for submission and use of the photo in accordance with these Terms & Conditions.

7. Prizes and Winners

Subject to compliance with these Terms & Conditions and availability of prizes, eligible participants shall be entitled to receive a custom-made Sunway Property Batik Pouch as described below. There will be a total of three hundred (300) winners. 

Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash or other items. Sunway Property reserves the right to substitute prizes with others of equal or higher value in the event of unforeseen circumstances without prior notice and without any obligation to compensate participants for any difference in value.  

Winners will be required to arrange for prize collection in person at the designated Sunway Property Sales Gallery subject to additional costs borne by the winner and all risks of loss or damage shall pass to the winner upon dispatch or collection. All prizes must be collected or redeemed within thirty (30) days of the winner announcement, failing which the prize will be forfeited without compensation and Sunway Property shall be entitled to deal with the unclaimed prize in its sole discretion. Sunway Property will not be liable for any additional expenses incurred by the winners, including but not limited to travel, accommodation, or postage costs or for any tax implications (if any) arising from the receipt of the prize. 

Sunway Property makes no representation or warranty as to the quality, merchantability or fitness for purpose of the prize and shall not be responsible for any defect or deficiency in the prize. 

8. Winners Judging & Announcement

All entries that comply with these Terms & Conditions and successfully submit an original Raya greeting of fifty (50) words or fewer via the official campaign submission form shall be deemed valid entries. 

Participants who indicate their interest in purchasing a Sunway Property through the submission form will be eligible to receive the Sunway Property x Komuniti Tukang Jahit Exclusive Batik Pouch, subject to availability and compliance with these Terms & Conditions. 

Eligibility for the Batik Pouch is based solely on: 

• A valid online submission;
•  A valid Raya-themed image/photograph;
• Selection of property purchase interest within the submission form. 

The Batik Pouch is limited to the first three hundred (300) eligible participants on a first-come, first-served basis, determined by submission timestamp. Eligible participants will be notified of their entitlement and required to collect the Batik Pouch in person at the Sunway Property Sales Gallery corresponding to the property selected during submission. The sales gallery serves strictly as a prize collection point and does not form part of the eligibility or judging criteria. 

By participating in the Giveaway, participants consent to the publication, disclosure and use of their names, photographs, likenesses, voices and general location for winner announcement, publicity, promotional and marketing purposes by Sunway Property without additional compensation, unless prohibited by law. 

Winners will be announced within thirty (30) working days after the campaign closing date via Sunway Property’s official social media platforms, including Instagram, Facebook, TikTok and XiaoHongShu, and may also be contacted via the details provided during submission. Sunway Property shall not be responsible for any failure by participants to receive or view such announcements. 

If any winner is found to be ineligible, unreachable, or fails to comply with prize collection requirements within the stipulated timeframe, Sunway Property reserves the right to disqualify the winner and select a replacement without liability. 

By participating in the Giveaway, participants consent to the publication, disclosure and use of their names, photographs, likenesses and general location for publicity, promotional and marketing purposes by Sunway Property without further compensation, unless prohibited by law

9. Disqualification 

Entries that do not comply with these Terms & Conditions will be disqualified without prior notice. Sunway Property reserves the right to disqualify any image deemed inappropriate, offensive, plagiarized, fraudulent, or contrary to the Giveaway’s ethos in its sole and absolute discretion, including but not limited to, content that violates intellectual property laws, misrepresents reality, or is submitted by unauthorized means and such decision shall be final and binding, subject always to applicable law. 

Sunway Property further reserves the right to disqualify any participant who tampers with the entry process, submits false or misleading information, or engages in conduct that may jeopardise the fair and proper conduct of the Giveaway. 

10. Data Protection 

Sunway Property will collect personal data about you (and your parent/guardian, where applicable) at the time of registration, and as otherwise necessary to administer the Giveaway, exhibitions, and all associated activities in accordance with the Personal Data Protection Act 2010 (“PDPA”). Your personal data may be disclosed to Sunway Property’s affiliates, service providers, agents and contractors (including those located outside Malaysia) strictly for Giveaway administration, marketing and related purposes, and by participating, you consent to such processing, disclosure and transfer. 

Participants acknowledge that their personal data will be processed in accordance with Sunway Property’s Privacy Policy, which is available on Sunway Property’s official website, and confirm that they have read and understood the same. Participants may request access to, correction of, or withdrawal of consent to the processing of their personal data in accordance with the PDPA, subject to any legal restrictions or contractual conditions.

11. Marketing, Promotional & Newsletter 

By entering this Giveaway, participants expressly consent to be subscribed to Sunway Property’s Marketing, Promotional and Newsletter services. Participants may unsubscribe from these communications at any time by following the instructions provided in the email.  

12. Others

12.1 Force Majeure, Amendment and Termination of Competition

Sunway Property reserves the right to amend, change or to withdraw the Giveaway and its prizes at any time or to terminate the Giveaway as and when necessary, without prior notice. Such amendments or modifications will take effect from the date they are published on Sunway Property’s official website or social media channels and continued participation in the Giveaway shall constitute acceptance of such amendments. 

In the event of unforeseen circumstances beyond Sunway Property’s reasonable control, including but not limited to natural disasters, pandemics, government-imposed restrictions, acts of God, war, civil commotion, strikes, lockouts, industrial disputes, system failures or disruptions of utilities or telecommunications services, Sunway Property reserves the right to suspend or cancel the Giveaway without liability. Participants acknowledge and agree that Sunway Property will not be held responsible for any loss or inconvenience arising from such amendments or termination.

12.2 Limitation of Liability and Disclaimer

To the fullest extent permitted under Malaysian law, Sunway Property, its affiliates, officers, employees, agents and contractors shall not be liable for any loss, damage, cost or expense of any kind (including loss of income, profits, goodwill or opportunity), whether direct or indirect, arising out of or in connection with the Giveaway, participation therein, reliance on any information provided, or the acceptance, use or misuse of any prize. All prizes are provided “as is” without any warranties, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose and Sunway Property shall not be responsible for any acts or omissions of third-party manufacturers or suppliers in relation to the prize. 

12.3 Investigation and Withholding Rights

Sunway Property reserves the right to investigate any suspected breach, fraud, manipulation or non-compliance with these Terms & Conditions and may, at its discretion, suspend, cancel or withhold any entry or prize pending the outcome of such investigation, without liability or obligation to provide reasons.

12.4 Errors and Technical Issues

Sunway Property shall not be responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorised access to, or alteration of entries, or any technical malfunction affecting participation in the Competition.

12.5 Governing Law and Jurisdiction

These Terms & Conditions and the Competition shall be governed by and construed in accordance with the laws of Malaysia, and the courts of Malaysia shall have exclusive jurisdiction over any dispute arising out of or in connection with the Competition.

12.6 Severability

If any provision of these Terms & Conditions is held to be invalid, illegal or unenforceable under applicable law, such provision shall be severed and the remaining provisions shall continue in full force and effect.

12.7 No Waiver

No failure or delay by Sunway Property in exercising any right, power or remedy under these Terms & Conditions shall operate as a waiver thereof, nor shall any single or partial exercise preclude any further exercise of such right or remedy.
